T-Visa Evidence Under Pressure: Explain Why the Survivor Is Here and What Cooperation Occurred

Two T-visa elements are often blurred in emergency filings: physical presence on account of trafficking and compliance with reasonable law-enforcement requests. They answer different questions and should have separate evidence maps.

Form I-914 adjudication applies the T-visa elements in 8 U.S.C. § 1101(a)(15)(T) and 8 C.F.R. § 214.11, including physical presence and reasonable cooperation requirements.

Write the physical-presence chronology

Begin with trafficking conduct and apply the correct age-based standard: sex trafficking of a person under eighteen does not require force, fraud, or coercion. Then explain escape, continued control, reporting, medical or psychological effects, participation in investigation, and other reasons the person remains in the United States because of trafficking. Connect each step to a document or witness.

Record every cooperation request and response

List the agency, officer, date, request, response, and any safety constraint. Include Supplement B if issued, but do not imply that certification is the only possible proof. Address any statutory exception directly.

Prove extreme hardship separately

Organize country conditions, retaliation risk, medical needs, access to justice, age and family circumstances, and trafficking-specific consequences. Avoid generic hardship paragraphs that could describe any removal case.

Overlay the detention record

Show when ICE learned of the T filing, what agency benefit existed then, whether a stay was requested, and whether deferred action or other protection was active. Keep this overlay separate from the eligibility memorandum.

Control sensitive disclosures

Use coded exhibits, redactions, sealed filings where authorized, and a disclosure log. The emergency audience rarely needs the survivor’s entire narrative to decide a custody or process question.
