Missed a California QME Appointment? Build the Record Before Seeking a Replacement

A missed qualified medical evaluator appointment can delay a California workers’ compensation claim, produce a cancellation-fee dispute, or trigger a fight about replacing the evaluator. The next step depends on why the appointment failed, what notice was given, and whether the medical-legal process can still proceed fairly.

Preserve the appointment and notice history

Keep the panel request, strike letters, appointment notice, proof of service, interpreter arrangements, records correspondence, travel plans, confirmation calls, and cancellation messages. Record the precise time, location, evaluator’s office contact, and what each person said. A calendar entry alone does not prove proper notice.

If the worker appeared but the evaluation did not occur, document arrival time, waiting time, identification presented, language access, office closure, or refusal. If the worker did not appear, document illness, emergency, transportation failure, defective notice, or other claimed good cause with contemporaneous evidence.

Communicate promptly and narrowly

Contact the evaluator’s office and the other side promptly to determine whether the appointment can be rescheduled and whether a cancellation fee is asserted. Confirm any agreement in writing. Do not assume that requesting a new date automatically preserves the same evaluator or waives an objection.

A party seeking a replacement panel must fit the governing statute and regulations; dissatisfaction or delay alone may not suffice. Explain the specific procedural defect and attach the supporting record rather than asking the Medical Unit to infer it.

Separate replacement, fee, and merits issues

Whether a replacement QME is appropriate is different from who owes a missed-appointment fee and different again from the medical merits. A replacement dispute should not become an opportunity to coach medical testimony or select a preferred outcome. Preserve neutrality and the statutory selection process.

If records were not timely supplied, identify who was responsible, what was served, and whether the evaluator could conduct a meaningful examination. If an interpreter or accommodation failed, document the request and the concrete effect on the appointment.

Protect the rest of the claim during the delay

Continue authorized treatment, disability certification, benefit communications, and hearing preparation while the medical-legal issue is resolved. A missed QME does not itself decide industrial causation, temporary disability, permanent disability, apportionment, or future care.

Build a deadline sheet for objections, panel requests, replacement requests, declarations of readiness, and any scheduled conference. The best record shows prompt corrective action without overstating what the regulations guarantee.
