An IRS levy and an FTB earnings-withholding order are not the same instrument. A taxpayer should identify the issuing agency, notice sequence, tax periods, employer instructions, and available review before requesting relief.

Identify the collection instrument

Collect the final notices, levy or withholding order, employer copy, account transcripts, tax periods, assessments, payments, and any prior agreement.

Confirm whether the problem concerns an active levy, a lien, an installment-agreement default, or a threatened action.

Document immediate financial impact

Prepare current income, necessary living expenses, dependents, bank balances, assets, debts, and unusual medical or support costs with documents.

A hardship assertion should connect the withheld amount to necessary expenses rather than rely on a conclusory statement.

Match the request to the agency

IRS collection alternatives and appeal processes differ from FTB procedures. Submit the correct financial form and supporting records to the correct unit, and preserve delivery and call records.

A release may address the current levy without resolving the underlying balance. Confirm what future payments or filings are required.

Verify implementation

Obtain the written release, confirm transmission to the employer or bank, and check the next payroll cycle. Keep the name and identification number of the agency employee when available.

If the employer continues withholding, determine whether it received and processed the release before assuming the agency failed to act.
