IRS Free File: Submitted to the Software Is Not Yet Accepted by the IRS

Submitting a return to tax software before the IRS filing season opens is not the same as receiving IRS acceptance. In its January 9, 2026 announcement, the IRS said Free File partners could accept returns early and hold them for electronic filing when the season began. Check the acknowledgment you actually received before treating the return as accepted or expecting a refund.

This article describes the January 2026 opening for 2025 federal income tax returns. Income limits, providers and opening dates can change in later filing seasons.

The January 9 opening was an early preparation opportunity

The IRS’s January 9 announcement, IR-2026-05, explained that guided Free File software was available before the official filing season began later that month. The partner could hold a prepared return for later electronic filing. That distinction matters if a confirmation says only that you submitted the return to the provider.

Read the confirmation closely. Does it identify a completed preparation step, a return waiting for transmission, or an IRS acknowledgment? Those messages answer different questions. A provider’s receipt of your information does not establish that the IRS has accepted the return, approved every figure or scheduled a refund.

Check the federal return and California return separately

For the 2026 program, the IRS announced eight guided-software partners and an eligibility ceiling of $89,000 in adjusted gross income for 2025. Each partner set its own offer conditions, which could include age, income, state residency and military status. Some offered free state preparation and filing as well; that was not a universal feature of every offer.

A California taxpayer should therefore check both the federal offer and the state offer before selecting a product. A federal confirmation also does not tell you whether a separate California return has been submitted or accepted. Keep the acknowledgments for each return rather than relying on a single account status.

Fillable Forms were a different option

The same announcement said Free File Fillable Forms would become available January 26, 2026. Those electronic versions of IRS paper forms were intended for people comfortable preparing their own returns using IRS instructions, including taxpayers above the guided-software income ceiling. They were not the January 9 guided-software opening.

Start from the IRS Free File page and read the applicable year’s offer. A commercial product’s general advertising may describe different terms from its IRS Free File offer.

Use the acknowledgment to identify the next step

If the software says the return is waiting, ask the provider what event it is waiting for. If it reports a rejection, identify the stated reason before submitting a correction. If the provider reports IRS acceptance but you later receive an IRS notice, compare the notice with the accepted return and acknowledgment. Do not assume that resubmitting the same return will resolve a different issue.

For a tax filing dispute, bring the return, each acknowledgment and any IRS or FTB notice. Our tax legal services can help identify whether the problem concerns submission, the return’s contents or a later agency decision. An early software submission alone does not answer those questions.
