Appealing an FTB Notice of Action to California OTA: Deadline, Issues, and Record

A disagreement with an FTB notice does not automatically become an appeal. The taxpayer must identify whether the document is appealable, calculate the deadline from the notice and governing rules, and file a focused record with California’s Office of Tax Appeals.

Identify the appealable document

OTA hears appeals from specified FTB and CDTFA determinations. In an FTB matter, a protest or refund claim commonly leads to a Notice of Action stating the agency’s determination and appeal rights. Use the exact document title, notice date, mailing information, taxpayer names, and account periods.

Do not treat a proposed assessment, collection letter, account transcript, or informal correspondence as interchangeable with a Notice of Action. If the document is unclear, review the governing procedure before selecting a filing route.

Calendar from the governing notice and rule

OTA warns that a taxpayer who does not appeal in writing before the deadline may lose the right to an OTA appeal. Preserve the envelope and electronic-delivery history and calculate the deadline under the current rules, including any special rule actually applicable to service or a weekend or holiday.

A request for explanation or reconsideration from FTB should not be assumed to extend the OTA period. File through the permitted channel and preserve a complete receipt showing the submission date and documents.

State each issue and the requested result

Organize the appeal by tax year and issue: income adjustment, residency, credit, penalty, refund denial, or another determination. For each, state what FTB decided, why the taxpayer disagrees, the legal authority, the supporting evidence, and the numerical change requested.

A large unsorted document upload makes it difficult to connect proof to an issue. Use an exhibit index and explain bank records, returns, contracts, residency evidence, or other documents without including unnecessary account details in a public filing.

Build the record for written or oral review

Track OTA correspondence, briefing deadlines, FTB’s response, requests for additional evidence, and any election concerning an oral hearing. Preserve the original return, protest, FTB notices, appeal, exhibits, and later orders as one version-controlled file.

An appeal does not by itself prove that collection activity is suspended in every circumstance. Confirm payment, interest, collection, and protective-claim consequences for the specific matter while the appeal proceeds.
